Terms and conditions

As of 8 October 2026. These terms apply to the use of FreelancerJury (freelancerjury.com), operated by webconia GmbH. The German version is legally binding.

1. Scope

These General Terms and Conditions govern the contractual relationship between webconia GmbH, Gänsemarkt 31, 20354 Hamburg (hereinafter the "Provider") and the persons who use FreelancerJury (hereinafter the "User"). By registering or uploading a CV, the User accepts these terms. Conflicting terms of the User do not apply.

2. Service

FreelancerJury is a web-based platform (software as a service) that compares a freelancer's profile, based on an uploaded CV, with the skills in demand on the market. The User receives a verdict with a market-fit score, findings, strengths, an hourly-rate check and training suggestions. The "Pro" plan adds further features (e.g. Skill Simulator and CV tailoring).

There is a free plan ("Free") and a paid plan ("Pro"). The scope of features of each plan is as described on the website at the time the contract is concluded. The Provider may further develop the platform and change features as long as the essential scope of services is maintained.

3. Market analysis without guarantee of results

The verdict is based on statistical analyses of project postings and on automated, AI-supported processing. It is guidance and not a forecast or assurance. The Provider does not broker assignments, does not guarantee projects, placements, income or career outcomes and does not provide legal, tax or career advice. Market data may be incomplete; hourly-rate values may in part derive from converted salary figures. AI suggestions (e.g. in CV tailoring) may contain errors; the User checks them before use and is responsible for the accuracy of their CV.

4. Registration and access

Use of the full results requires an account. The User must provide truthful information, keep their credentials secret and inform the Provider of unauthorised access. An account is not transferable.

5. Obligations of the User

The User may upload only their own CVs or those they are authorised to process. In particular, it is prohibited to:

  • upload content that infringes third-party rights, is unlawful or contains malware;
  • use automated access, scrape the market data or make access that impairs operation or circumvents protective measures (e.g. rate limits);
  • use the platform to systematically copy or resell market data or verdicts or to build competing services;
  • attempt to circumvent security mechanisms or the anonymisation, or submit input aimed at manipulating the AI processing.

6. Rights of use and uploaded data

For the duration of the contract the Provider grants the User a simple, non-transferable right to use the platform for their own purposes. All rights in software, design, trademarks and market data lie with the Provider or the respective rights holders.

The User retains the rights to their content, in particular their CV. The User grants the Provider the right to process the uploaded data solely to provide the service (reading, anonymisation, analysis by AI services, storage, creation of drafts and exports). The Provider does not use the uploaded data for other purposes and does not pass on verdicts or CV content to clients or recruiters. Anonymised skill information not related to any person may flow into the market data base. Details, periods and deletion are governed by the privacy policy.

7. Prices, term and payment

The "Pro" plan is billed monthly only. The price is a gross price including statutory VAT and is shown to the User before the order on the website and in checkout; the price shown at the time of order applies. Payment is made in advance through the payment service provider Stripe. Pro renews automatically for a further month unless cancelled in time.

Trial period: If the Provider offers a free trial period, its duration is stated before the order. It starts with the order of Pro and, once it ends, automatically converts into the paid monthly subscription unless the User cancels before the trial period expires. The Provider points this out before the order.

Payment failure: If a due payment cannot be collected successfully, Pro ends immediately and the account moves to the Free plan.

The Provider announces price changes in text form at least four weeks before the end of the current period; until then the User may cancel effective at the end of the period.

8. Cancellation

The Free plan can be ended at any time by the User deleting their account. The User can cancel Pro at any time, effective at the end of the current paid period, in the "Account" area; until then all Pro features remain available. After that the account moves to the Free plan. Amounts already paid for the current period are not refunded pro rata in the case of ordinary cancellation.

If the User deletes their account, a running Pro subscription is ended; invoice data remains stored within the scope of statutory retention obligations. The handling of Pro data after the subscription ends is set out in the privacy policy.

The right of both parties to terminate for good cause remains unaffected; in particular the Provider may block accounts in the event of serious violations of clause 5.

9. Right of withdrawal for consumers

Consumers have a statutory right of withdrawal of 14 days from conclusion of a paid contract. A clear statement to webconia GmbH, Gänsemarkt 31, 20354 Hamburg, email: [email protected], is sufficient to exercise it.

If the consumer expressly requests that the Provider begin performance before the withdrawal period expires and confirms in checkout that they lose their right of withdrawal once the contract has been fully performed, the right of withdrawal expires upon full performance of the service. If the consumer withdraws before that point, they must pay compensation for the services provided up to then. Without this consent the Provider does not begin the paid service before the withdrawal period has expired.

Businesses (freelancers acting in the course of their self-employed activity) have no right of withdrawal.

10. Availability

The Provider strives for high availability but cannot guarantee uninterrupted availability. Maintenance work will be announced where possible.

11. Liability

The Provider is liable without limitation in cases of intent and gross negligence, for injury to life, body or health, under the Product Liability Act and to the extent it has assumed a guarantee. In the case of slightly negligent breach of essential contractual obligations (obligations whose fulfilment is a prerequisite for proper performance of the contract and on whose observance the User may regularly rely), liability is limited to the foreseeable damage typical for this type of contract. In all other respects liability for slight negligence is excluded. For decisions the User makes on the basis of the verdict or AI suggestions, the Provider is liable only in accordance with this provision.

12. Data protection

How we process personal data is set out in our privacy policy.

13. Changes to these terms

The Provider may change these terms with effect for the future if there is a valid reason (e.g. change in law, new features). Changes are notified to the User in text form at least four weeks in advance. If the User does not object within this period, the changes are deemed approved; the notification will point this out.

14. Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods; towards consumers this choice of law applies only insofar as it does not deprive them of mandatory consumer protection provisions of their country of residence. The place of jurisdiction for disputes with merchants, legal entities under public law and special funds under public law is Hamburg. Should individual provisions be invalid, the validity of the remainder remains unaffected.
